The divorce process

To start the divorce process, the individual asking for the divorce (the petitioner) must file the proper paperwork with the district court and formally serve the other spouse (the respondent). The petitioner must take this step within 120 days of filing the petition, and the respondent has 20 days to answer. Then, both partners must file financial declarations disclosing all of their assets, property and debts.

Under state law, there is a mandatory 90-day waiting period between the petition filing and when the divorce can be finalized. You may move to have this waiting period waived if you can demonstrate to the court there are extraordinary circumstances pertaining to your case. Another requirement in some divorce cases is mandatory mediation, in which both partners must attend a mediation session to work out any points of contention, such as disagreements related to child custody, child support, alimony, or marital property division. If the spouses are the parents of minor children, they may also be required to attend divorce education classes to help their kids deal with the separation.

Fault and no-fault divorces

Sometimes one spouse is primarily responsible for the dissolution of a marriage, while in other situations, neither spouse is more at fault than the other. In a fault divorce, one spouse alleges that the marriage dissolution is taking place due to issues like adultery, incarceration, desertion, domestic violence, abuse, mental illness or substance abuse. A no-fault divorce occurs when the parties are dissolving their marriage because of irreconcilable differences. If one spouse wishes to get a divorce and the other does not, there is no legal way to prevent the divorce from moving forward.
